What Is Building Compliance in NSW?

Building compliance is the act of ensuring that a building or structure (residential, commercial, industrial or mixed use) complies with all the relevant codes, standards and legislative requirements during its lifecycle. These requirements are mostly regulated in New South Wales by:

  • National Construction Code (NCC) / Building Code of Australia (BCA) which establishes minimum performance requirements in terms of structural integrity, fire safety, energy efficiency, health and amenity, and access and egress.
  • The Environmental Planning and Assessment Act 1979 (EP&A Act), on which the development application, construction certificate and occupation certificate system is based.
  • Disability Discrimination Act 1992 (DDA) and Australian Standard AS 1428, which require accessible design of buildings, whether residential or commercial.
  • NSW Fair Trading licensing of building compliance practitioners and private certifiers.
  • Local Environment Plans (LEPs) and Development Control Plans (DCPs) established by individual councils.

Failure to comply with any of these requirements may lead to stop-work orders, enforcement action, financial fines and major project delays. In severe instances, non-compliant buildings might be ordered to be partially or completely demolished and reconstructed. The best solution is to hire a qualified building compliance consultant, in NSW, at the earliest stage of the design process to ensure that any problems that may arise are detected and sorted out before they turn into costly problems.

Our Building Compliance Services in Sydney

AllCert Group provides a complete range of building compliance services to the requirements of developers, builders, architects and building owners in Sydney and NSW. We provide services at all phases of the project life cycle – starting with the first review of the design and continuing with post-construction audits and compliance management.

1. BCA Compliance Assessments and Reports

Our compliance check of BCA in Sydney will give a comprehensive examination of your architectural and engineering documents against the provisions of the National Construction Code. We establish non-compliant items, offer other solutions where the deemed-to-satisfy requirements are not achievable, and prepare a detailed building  compliance code report that fulfills the needs of your certifier, council or other authority.

Our BCA compliance reports are straightforward, well-organized reports that are written in both technical and non-technical language. They are recognised by local councils and private certifiers throughout NSW and are usually mandatory in relation to development applications, construction certificate applications and processes of occupation certificates.

2. Site Compliance Audits

A site compliance audit is a physical examination of a building or construction site to determine whether the work performed to date meets the approved plans, the BCA and all applicable Australian Standards. The site audits conducted by AllCert Group are especially useful to:

  • Early detection of compliance gaps during construction before correction is expensive.
  • Due diligence evaluations before purchase or lease of property.
  • Audits on current buildings after completion to ascertain continued compliance.
  • The owners of strata and commercial buildings who are to comply with the Building and Development Certifiers Act 2018.

3. Design Review and Compliance Advice

At the design phase, that is, prior to the filing of a development application, our building compliance consultants in NSW will review architectural drawings and documentation to determine the possible problem and offer viable and design sensitive solutions. Early intervention implies that compliance issues are addressed off-site and not on-site, which saves a lot of time and money. In conjunction with design teams, we collaborate in balancing compliance needs with the design intent of the architect and commercial goals of the client.

4. Approval Support — DA, CC, CDC and OC

The NSW approval pathway may consist of various certificates and stakeholders. AllCert Group offers practical assistance at every level:

  • Development Application (DA): Providing recommendations on BCA, DDA and planning compliance to facilitate lodgement and approval.
  • Construction Certificate (CC): Examination of construction documentation and delivering BCA compliance sign-off.
  • Complying Development Certificate (CDC): Evaluation of eligibility and control of the CDC pathway as an alternative to DA.
  • Occupation Certificate (OC): Assuring that the building is ready to occupy, and that it complies with all the applicable standards.

5. Fire Safety Compliance

One of the most important – and regulated – building compliance in NSW is fire safety compliance. AllCert Group performs thorough fire safety audits which involve:

  • Passive fire protection systems (fire-rated walls, floors, doors, penetrations)
  • Active fire suppression systems (sprinklers, fire hydrants, hose reels) Fire detection and alarm systems.
  • Egress routes, exit door, travel distance and stairwell compliance.
  • Fire Safety Statement (AFSS) preparation assistance annually.

Our fire safety compliance assessments are benchmarked against the BCA, Australian Standards (including AS 1851 and AS 1670), and the NSW Environmental Planning and Assessment Regulation. We work closely with fire engineers and certifiers to ensure a coordinated outcome.

6. Accessibility Compliance — DDA and AS 1428

Inclusive design is not only a legal obligation but also a good investment. The accessibility compliance services of AllCert Group deal with the needs of the Disability Discrimination Act 1992, the BCA (Part D3, F2.4 and other provisions) and the Australian Standard AS 1428 the most important standard of accessible facilities design. Our assessments cover:

  • Available routes of passage between the street boundary and the building compliance.
  • Lift sizes, door clearances and controls.
  • Parking facilities, washrooms, drinking water and signs.
  • Check-in desks and customer service points, reception counters.
  • Tactile signs, directional and emergency signs.

7. Energy Efficiency — NCC Section J

All buildings in NSW in Class 2-9 must comply with energy efficiency requirements under NCC Section J (now Part J of the NCC 2022). AllCert Group analyses your energy efficiency documentation, such as NABERS commitments, glazing calculations, insulation schedules and building fabric specifications, to ensure compliance and find ways to reduce long term operating costs without affecting the design.

8. Post-Construction Compliance and Upgrades

The compliance obligations are not terminated with the occupation certificate. Current buildings are liable to continued maintenance demands, yearly fire safety reports, access upgrade demands and legislative modifications. AllCert Group offers post-construction compliance services to the strata managers, commercial building owners, facility managers and heritage property owners who should be aware of and comply with their continuing regulatory requirements.

Our Approach to Building Compliance

The compliance methodology of AllCert Group is developed on the basis of four principles which constantly provide our clients with higher results:

Early Intervention

The least expensive compliance plan is to comply early. We check concept designs, schematic drawings and design development documentation to find compliance gaps before they are entrenched in construction documents. One concept review is usually less expensive than a day of on-site rework.

Practical, Design-Sensitive Solutions

Conformity need not imply conformity. Where the deemed-to-satisfy requirements of the BCA are not practical to satisfy, we develop alternative solution justifications and Performance Solution reports that satisfy the same or better level of performance without losing the intent of the architect. We have a good history of attaining alternative solutions that are accepted by certifiers and councils in NSW.

Collaborative Stakeholder Engagement

The results of compliance are seldom attained alone. AllCert Group collaborates with architects, engineers, certifiers, council planners and fire engineers directly to make sure that compliance recommendations are aligned and that the approval process is as seamless as possible. We visit site meetings, attend design workshops and attend council pre-lodgement meetings on behalf of our clients.

Future-Proofing

Regulatory requirements evolve. The NCC 2022 brought major changes to the provisions of energy efficiency and accessibility, and additional changes are anticipated. The advice provided by AllCert Group does not only look at the current compliance requirements but also anticipates the changes in legislation that are likely to impact on the continued compliance of your building. This is a long-term strategy to safeguard your investment.

Case Studies

Commercial Office Fit-Out: Accessibility issues were noted early in the design process, saving the client time and money on reworking. Residential Development: Our compliance audit facilitated council approvals, saving the project six weeks. Healthcare Facility: We ensured high-level accessibility and fire safety requirements were maintained, allowing smooth certification.
